These Terms of Service (“Terms”) govern your access to and use of BoreWise, including the BoreWise website, software, tools, content, and related services (collectively, the “Service”). By accessing or using BoreWise, you agree to these Terms. If you do not agree, do not use the Service.
BoreWise is planning software designed to assist users with bore-path visualization, calculations, and related planning workflows. BoreWise is an advisory software tool only.
BoreWise is not a licensed engineering firm and does not provide engineering, surveying, legal, safety, or professional services. Use of BoreWise does not replace professional judgment, field verification, or compliance obligations.
Outputs generated by BoreWise are estimates based on user inputs, assumptions, formulas, and software logic. BoreWise does not guarantee accuracy, completeness, suitability, legality, or fitness for any specific project or condition.
You are solely responsible for:
Drilling and excavation activities involve inherent risk. By using BoreWise, you assume all risks associated with reliance on the Service or drilling operations, including utility strikes, delays, property damage, environmental damage, equipment damage, bodily injury, or death.
To the fullest extent permitted by law, BoreWise, its owners, affiliates, contractors, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, business opportunity, goodwill, or project losses arising from or related to the Service.
To the fullest extent permitted by law, BoreWise’s total aggregate liability for any claim relating to the Service shall not exceed the amount you paid to BoreWise in the twelve (12) months preceding the event giving rise to the claim.
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, non-infringement, title, or fitness for a particular purpose.
You are responsible for maintaining the confidentiality of account credentials and for all activity occurring under your account.
Paid plans may renew automatically on a recurring basis unless canceled before the next billing date. Free trials are for legitimate evaluation use only. Prices may change with reasonable notice. Unless otherwise stated, fees are non-refundable except where required by law.
Subject to these Terms and payment of applicable fees, BoreWise grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes.
BoreWise retains all rights, title, and interest in the Service, including software, algorithms, branding, logos, text, design, and intellectual property. No ownership rights are transferred to you.
You may not:
BoreWise may modify, suspend, update, or discontinue any part of the Service at any time, with or without notice.
BoreWise may suspend or terminate access for violation of these Terms, misuse of the Service, nonpayment, or risk to the platform.
Use of the Service may involve collection and processing of account and usage data. A separate Privacy Policy may apply.
These Terms are governed by the laws of the State of Missouri, USA, without regard to conflict of law principles.
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
BoreWise may update these Terms at any time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
